These Terms & Conditions (“Terms”) govern your access to and use of the Tales & Conquest™ video game (the “Game”) and the website located at https://talesgame.com (the “Site”), both owned and operated by Gnome Labs (“Gnome Labs,” “we,” “us,” or “our”). By creating an account, accessing, or using the Game or the Site, you agree to be bound by these Terms.

1. Governing Law & Jurisdiction

1.1 Governing Law. These Terms shall be governed by and construed in accordance with the laws of the State of Florida, USA, without regard to conflict of law principles.

1.2 Arbitration & Dispute Resolution.

Mandatory Arbitration. Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be settled by binding arbitration in Florida, USA, before a single arbitrator.

Class Action Waiver. You expressly agree to resolve disputes on an individual basis, and you hereby waive any right to participate in a class action lawsuit or class-wide arbitration.

2. Eligibility & Age Restriction

2.1 Age Requirement. The Game and the Site are intended for individuals who are at least 18 years old. By creating an account or otherwise using the Game or the Site, you represent and warrant that you are at least 18 years of age. Anyone under 18 is strictly prohibited from using or accessing the Game or the Site.

3. Account Creation & Management

3.1 Account Registration. To access the Game, you must create a user account. You may use a pseudonym for your account rather than your real name.

3.2 Account Suspension & Termination. We reserve the right to suspend, restrict, or terminate any account that we, in our sole discretion, deem suspicious, in violation of these Terms, or otherwise contrary to our interests.

3.3 User Responsibilities. You are responsible for all activities that occur under your account and for maintaining the confidentiality of your login credentials. If you suspect any unauthorized use of your account, please notify us immediately at [e-mail].

4. User Conduct & Prohibited Activities

4.1 Prohibited Actions. You agree not to engage in any prohibited activities, including but not limited to:

• Cheating, hacking, exploiting bugs, or using bots or unauthorized scripts.

• Any activity that violates any applicable law or regulation.

• Any behavior that could be deemed harmful, deleterious, or disruptive to other players or the Game’s integrity.

4.2 No Moderation. Gnome Labs does not actively moderate or monitor user content, chat, or gameplay interactions. You acknowledge and accept that all players may create and experience their own adventures within the Game.

4.3 Consequences of Violation. If you engage in any prohibited activity, Gnome Labs reserves the right, at its sole discretion, to take appropriate action, including without limitation suspension or termination of your account.

5. Subscription & In-Game Purchases

5.1 Subscription Service. Tales & Conquest™ operates on a subscription model. You will be charged a monthly fee to access the Game.

5.2 Additional Purchases & Microtransactions. We may introduce additional in-game purchases and microtransactions, including virtual items and/or currency (“Virtual Goods”), which you may acquire for real money. All details regarding Virtual Goods will be made available in the Game or on the Site.

5.3 Refunds for Subscription. You may request a refund for your subscription by contacting us at [e-mail], subject to our then-current refund policies. Gnome Labs reserves the right to approve or deny refund requests at its sole discretion, in accordance with applicable law.

6. Virtual Goods & Marketplace

6.1 In-Game Currencies & Items. Tales & Conquest™ may include one or more forms of in-game currencies and items.

6.2 Official Marketplace. You may trade or sell your in-game currencies or items only through the official Tales & Conquest™ marketplace. Any trades outside our official marketplace are at your sole risk, and Gnome Labs is not liable for any losses, scams, or disputes arising from such external transactions.

6.3 Refunds for Marketplace Transactions. No refunds will be processed for peer-to-peer transactions conducted via our official marketplace. All such transactions are final once completed.

7. Intellectual Property

7.2 Tales & Conquest™. Tales & Conquest™ is an unofficial trademark of Gnome Labs. You may not use, copy, or modify our trademarks without our prior written consent.

7.3 Permission for Public Use. Users must obtain explicit permission from Gnome Labs before publicly using any Gnome Labs trademarks or materials, or before publicizing any information about Gnome Labs.

8. Disclaimers & Limitation of Liability

8.1 Cutting-Edge Technology & Risk. You understand that Tales & Conquest™ involves experimental, cutting-edge technology and may be subject to bugs, glitches, server downtime, hacks, theft, or lost progress. You agree to use the Game at your own risk.

8.2 No Liability. To the fullest extent permitted by law, Gnome Labs and its employees, officers, directors, contractors, and affiliates disclaim any liability for damages, losses, or harms of any kind (including monetary loss, downtime, or lost progress) arising from or in connection with your use of the Game or the Site.

8.3 Partner Sites. Gnome Labs is not liable for any issues, damages, or losses that may occur on partner sites or platforms (including Twitter/X). Your interactions on such platforms are governed by the respective platform’s terms and policies.

9. Termination & Account Deletion

9.1 User-Initiated Termination. You may request deletion of your account by emailing [e-mail]. Upon processing your request, your account will be closed and you will no longer have access to the Game.

9.2 Virtual Goods & Assets. If you wish to terminate your account, you must transfer or sell all in-game assets or currencies before doing so. Any assets remaining in your account upon termination may be lost permanently, and Gnome Labs is not responsible for restoring them afterward.

10. Changes to These Terms

We reserve the right to update or modify these Terms at any time without prior notice. It is your responsibility to regularly check these Terms for any updates or changes. Your continued use of the Game or the Site after any changes indicates your acceptance of the updated Terms.
